The Decommissioning Phase of Solar Leases involves the removal of any solar-gathering devices, electric transmission lines, and all above-ground facilities. The Decommissioning Term must be aggressively negotiated to assure proper cleanup and removal of all Solar Facilities. Decommissioning must require removal of all above-ground facilities down to a certain depth below the ground. For example, a farmer may request that the Decommissioning Term involves removal of all surface facilities down to four or five feet below the Earth’s surface. Decommissioning should also require reclamation of roadways, electrical and transmission easement areas, and the entire project area. Decommissioning is an important aspect of all Solar Leases as this crucial phase addresses how the company is going to remove Solar Facilities and reclaim the property upon the conclusion of the Solar Lease.
