As solar development is relatively new in Pennsylvania, property owners protect themselves through adequate insurance. Property owners should consult with their insurer prior to negotiating a Solar Lease Agreement to be sure that they can protect themselves from future liability.

The property owner/landlord should negotiate to require the solar company to include the property owner as an “additional” insured on the insurance policy covering the project for the entirety of the Solar Lease Agreement. Even as an additional insured, the property owner must consult with their insurer to maintain adequate insurance to protect against any unforeseen liability.
